By accessing or using SiteGrade ("the Service"), operated by NuStack Digital Ventures LLC ("NuStack", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

SiteGrade provides automated website analysis and scoring services. We crawl publicly accessible websites and generate reports covering technical SEO, conversion optimization, messaging, trust signals, UX, and site structure. Reports are for informational purposes only and do not constitute professional consulting advice.

3. Use of the Service

You may use SiteGrade only for lawful purposes. You agree not to:

• Submit URLs you do not own or have authorization to audit
• Attempt to reverse engineer, scrape, or automate access to the Service in ways that overload our infrastructure
• Use the Service to harass, investigate, or infringe on the privacy of third parties
• Submit false or misleading information
• Circumvent rate limits or access controls

4. Account and Email

Unlocking your full report requires providing an email address. You represent that this email address belongs to you. By providing your email, you consent to receive your audit report and occasional communications from NuStack related to website optimization. You may unsubscribe at any time.

5. Intellectual Property

The SiteGrade platform, its scoring algorithms, report formats, and all associated content are the intellectual property of NuStack Digital Ventures LLC. You may share your individual audit report for personal or business use. You may not reproduce or resell the platform, scoring methodology, or report templates without written permission.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. NUSTACK MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. AUDIT RESULTS ARE GENERATED AUTOMATICALLY AND MAY NOT REFLECT ALL ISSUES WITH YOUR WEBSITE. WE DO NOT GUARANTEE THAT IMPLEMENTING OUR RECOMMENDATIONS WILL ACHIEVE ANY PARTICULAR RESULT.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NUSTACK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF SITEGRADE SHALL NOT EXCEED $100 USD.

8. Third-Party Websites

When you submit a URL, we crawl that website to generate your report. We are not responsible for the content of third-party websites. We do not store the full content of crawled pages beyond what is required to generate your report. Crawl data is retained for up to 6 hours for caching purposes.

9. Rate Limits

To maintain service quality, each email address is limited to 5 audits per 24-hour period. We reserve the right to adjust rate limits or suspend access to users who abuse the Service.

10. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms. Material changes will be noted with an updated "Last updated" date.

11. Governing Law

These Terms are governed by the laws of the State of Wisconsin, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Wisconsin.
